By using the Platform, you acknowledge that we collect, use, and disclose personal information as described in this Privacy Policy. Where required by applicable law, we will request your consent before collecting or using your personal information for specific purposes.

5. Tutor Profile Promotion

Tutors may choose to have their Vocally profile — including their name, profile photo, biography, languages offered, and introductory video — featured on Vocally Global's social media channels for promotional purposes at no cost to the tutor.

This is entirely optional. Tutors can opt in or withdraw their consent at any time through their account settings under Profile Preferences. Withdrawal of consent will not affect any promotional use that occurred prior to withdrawal.

Vocally Global will not use a tutor's profile for paid advertising or third-party commercial purposes without separate explicit consent.

8. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce our agreements. When you delete your account, we will delete or anonymize your personal data within 30 days, unless a longer retention period is required or permitted by applicable law, including for financial records, tax compliance, fraud prevention, or legal disputes.

We implement industry-standard technical and organizational measures to protect your information, including encryption in transit (TLS/SSL), secure data storage, access controls, and regular security assessments. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

In the event of a confidentiality incident (a privacy breach or unauthorized access to personal information), Vocally Global will take prompt action to contain and assess the incident. Where required by applicable law, including Quebec's Act Respecting the Protection of Personal Information in the Private Sector and PIPEDA, we will notify affected individuals and the relevant regulatory authority (including the Commission d'accès à l'information (CAI) in Quebec) where there is a risk of serious injury.

10. Minor Users

Students aged 13 and older may use the Platform. Students under 18 may use the Platform only with the consent and supervision of a parent or legal guardian, where required by applicable law. Where a parent or guardian creates and manages the account on behalf of a minor, they represent that they have the authority to do so and consent to this Privacy Policy on behalf of the minor.

We apply additional care to the personal information of minor users. We do not use minor users' personal information for marketing purposes without explicit parental consent. If we learn that personal information has been collected from a student under 13 without a parent or guardian account, we will delete it promptly.

The Platform is not directed to children under 13. If you believe a child under 13 has created an account independently, please contact us at privacy@vocallyglobal.com.

Where required by applicable law, we use contractual and other safeguards to protect personal information transferred outside Quebec or Canada, in accordance with Quebec Law 25, PIPEDA, and other applicable requirements.

We may update this Privacy Policy from time to time. We will notify you of material changes by email or prominent in-app notice at least 30 days before the changes take effect. Your continued use of the Platform after the effective date means the updated policy applies to your use of the Platform. Where required by law, we will request your consent for material changes.

14. Quebec and Canadian Privacy Rights

If you are located in Quebec or elsewhere in Canada, you have rights under Quebec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25) and PIPEDA, including the right to access, correct, and in some cases request deletion of your personal information. You may also lodge a complaint with the Commission d'accès à l'information (CAI) at www.cai.gouv.qc.ca or the Office of the Privacy Commissioner of Canada at www.priv.gc.ca.

If you are in the European Economic Area or United Kingdom, Vocally Global processes your data under lawful bases including contract performance, legitimate interests, and consent. You have additional rights including the right to lodge a complaint with your local data protection authority. For data transfers outside the EEA/UK, we rely on Standard Contractual Clauses or other approved mechanisms.

16. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the right to know what personal information we collect, request deletion, opt out of the sale or sharing of personal information (we do not sell your data), and not be discriminated against for exercising your rights.
